The United States has six states where online casinos are legal. These are Nevada, Delaware, Mississippi, Montana, Pennsylvania, and West Virginia.

The federal government has taken steps to regulate the Internet. It has made laws to punish and prevent illegal online gambling. These laws include the Unlawful Internet Gambling Enforcement Act (UIGEA) and the Wire Act. However, the laws are being challenged on constitutional grounds.

The First Amendment has been used as a basis for attacking federal gambling laws. The Constitution’s Commerce Clause and Due Process Clause have also been used as a basis for attacking the laws. In some cases, the due process arguments have been successful. In other cases, they have not been successful.

Another constitutional issue involved in the prosecution of Internet gambling is Section 1956. This statute creates several crimes. The criminal acts include laundering with the intent to promote illicit activity, concealing an illicit transaction, and evading taxes.

The United States has also charged Internet poker operators with UIGEA violations. These operators are charged with money laundering. The case is in progress and will likely be tried in court.
