The enforcement of federal laws prohibiting online gambling has been controversial. Several constitutional challenges have been raised. Some have focused on the Commerce Clause and the First Amendment guarantee of free speech. The Commerce Clause’s limited protection for crimes facilitating speech, however, has weakened these arguments. Due process arguments have been more effective.

Online gambling is regulated by the Online Gambling Regulation Act 2001, commonly known as OGRA. The Gambling Supervision Commission has the power to suspend or terminate licenses. For example, a company may lose its license if it does not comply with OGRA. OGRA has provisions for determining the amount of income a company can receive.

Federal law has limitations on the type of money a person can make with online gambling. Some states have laws that ban the online use of telecommunications to place bets. This includes Internet poker sites. Those that offer online gambling services should follow these laws. It may even be illegal for individuals to place a bet in a foreign country if they’re using a foreign bank account to fund the transaction.
